1. Acceptance of Terms & Intermediary Status

By accessing, registering, generating QR stickers, or scanning codes on Qwner (operated by Kumawatpulse Technologies, India), you enter into a legally binding contract governed by these Terms & Conditions. Qwner operates as an intermediary under Section 79 of the Information Technology Act, 2000 and adheres to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Digital Personal Data Protection Act, 2023 (DPDP Act 2023). If you do not accept these terms in their entirety, you must immediately cease using the platform.

2. Permitted Use & User Conduct

Qwner is designed for personal property recovery, residential society vehicle communication, child safety, student equipment protection, and corporate asset labeling. You agree to use the service solely for lawful purposes. You strictly agree NOT to:

• Use masked calling or proxy messaging to harass, stalk, threaten, abuse, or defame any person.
• Place stickers on public property, unauthorized vehicles, or third-party belongings without proper authorization.
• Engage in phishing, spoofing, fraud, or generate QR codes directing users to malicious software or counterfeit services.
• Reverse-engineer, scrape, DDoS, or attempt to bypass the authentication mechanisms of the platform.

3. Service Availability, Maintenance & Downtime Disclaimers

The Qwner platform, its QR redirection engines, and proxy telecommunications services are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise:

• Potential Downtime: Like any digital web or cloud infrastructure, Qwner may experience temporary outages, service interruptions, database synchronization delays, or scheduled maintenance without prior notice.
• No 100% Uptime Guarantee: We do not warrant that the service will meet your specific operational needs, will be completely error-free, uninterrupted, or that every scan or phone alert will be delivered successfully.
• Third-Party Telecom Dependencies: Masked phone calls and SMS notifications depend on global carrier networks and cellular infrastructure outside our control. Network congestion, carrier filtering, or signal failures do not constitute a breach of service by Qwner.
• Physical Sticker Durability: Qwner provides digital templates. We are not liable for physical degradation, ink fading, adhesive detachment, weather damage, or vandalism to physical stickers.

4. Limitation of Liability

To the maximum extent permitted under applicable law in India:

• Zero Direct or Consequential Liability: In no event shall Qwner, Kumawatpulse Technologies, its founders, directors, employees, or contractors be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages.
• No Property Liability: Qwner does not guarantee the recovery of any lost item, pet, vehicle, laptop, or bag. Qwner is not an insurer or security provider and assumes no liability for theft, damage, or loss of any property bearing a Qwner sticker.
• Liability Cap: In any event, the total aggregate liability of Qwner for any claim arising from or related to the service shall be strictly capped at the amount actually paid by you to Qwner in the preceding three (3) months, or INR 500 (whichever is lower).

5. Mandatory Arbitration & No-Litigation Agreement (No Court Cases)

Please read this clause carefully, as it significantly affects your statutory rights:

• No Court Cases / Waiver of Litigation: You explicitly agree that you shall NOT initiate, file, maintain, or prosecute any civil lawsuit, court case, writ petition, or legal proceeding against Qwner or Kumawatpulse Technologies in any court of law or judicial forum.
• Mandatory Individual Arbitration: Any controversy, claim, or dispute arising out of or relating to these Terms, the Privacy Policy, or the use of Qwner shall be resolved solely and exclusively through final, binding individual arbitration under the Arbitration and Conciliation Act, 1996 of India.
• Arbitration Tribunal: The arbitration shall be presided over by a sole arbitrator mutually appointed by the parties, or failing agreement within 30 days, appointed by the appropriate High Court.
• Seat & Venue: The seat, venue, and place of arbitration shall be Rajasthan, India, and proceedings shall be conducted strictly in the English language.
• Waiver of Class Action: All claims must be brought in the user’s individual capacity, and not as a plaintiff, representative, or class member in any class, collective, or representative proceeding.
• Statute of Limitations: Any cause of action or claim arising out of the service must be submitted to arbitration within one (1) year after the claim arose; otherwise, such claim is permanently barred.

6. Indemnification

You agree to indemnify, defend, and hold harmless Qwner, Kumawatpulse Technologies, its affiliates, officers, directors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and reasonable legal fees arising from:

• Your misuse of the platform or violation of these Terms.
• Your infringement of any intellectual property or privacy rights of any third party.
• Any harassment, stalking, or unlawful communication sent through our proxy systems using your account.
• Disputes between you and any third party (including finders, apartment neighbors, or vehicle owners).

7. Governing Law & Jurisdiction

These Terms shall be interpreted, construed, and governed in accordance with the laws of the Republic of India, without giving effect to conflict of laws principles. Subject to the mandatory arbitration clause above, any legal matters requiring court intervention (such as enforcement of an arbitral award) shall be subject to the exclusive jurisdiction of the competent courts in Rajasthan, India.

8. Termination & Modifications

We reserve the right to suspend or terminate your account or access to the platform at our sole discretion, without prior notice, if you violate these terms or engage in fraudulent activities. We may update these terms from time to time; your continued use of Qwner constitutes acceptance of updated terms.

9. Product Orders & Acceptance

All product orders placed on Qwner are subject to these Terms, our Privacy Policy, and the dedicated store policies referenced below. When you place an order you are making an offer to purchase products. Orders are accepted in accordance with our processing rules — acceptance may be confirmed separately by email or through your order status rather than at the moment of checkout.

10. Personalized Products

Every Qwner product contains a unique, customer-specific QR code assigned to your order. Because the product is prepared specifically for you and may not be resold to another customer after personalization, once personalization or production has started, cancellation or return due to change of mind may be limited.

11. Pricing & Payment

Prices are shown in Indian Rupees (INR) and, where available, US Dollars (USD) as a display conversion. The price charged is the amount shown at checkout for your selected product, quantity and shipping destination. Payment is processed through our partner payment gateway; cash on delivery is not available. Relevant taxes are included in the totals shown at checkout.

12. Cancellation, Refund & Replacement

Cancellation, refund and replacement of products are governed by our Cancellation Policy, Refund & Replacement Policy, and Replacement Policy. These policies are business policies and are subject to applicable law.

13. Shipping & Delivery

Orders move through order verification, QR personalization, production, dispatch and delivery. Production time is separate from shipping time. Delivery is fulfilled by third-party carriers; once dispatched, delivery is subject to carrier handling. See the Shipping Policy for details.

14. QR Usage & User Responsibilities

Your Qwner QR code is assigned to you and your order. You are responsible for:

• Setting and maintaining accurate return details in your account.
• Using the code and the return flow lawfully and without harassing any person.
• Placing tags only on items you own or are authorized to tag.
• Keeping your account credentials secure.

15. Intellectual Property

The Qwner name, logo, product designs, website content and the signature QR styling are the intellectual property of Qwner and its operators. When you purchase a product you receive the physical product and the personally assigned QR code for your own use; nothing in these terms grants you rights to the Qwner brand or platform beyond your personal, lawful use of the product.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to the store, the platform, or applicable requirements. Updated terms take effect when published on this page. Material changes will be reflected here, and your continued use of Qwner after an update constitutes acceptance of the updated terms.
